By participating in the Rivian Rewards Program (the “Program”), you agree to these Terms and Conditions (the “Terms”) as well as the Rivian General Terms and Data Privacy Notice (together, the “Additional Terms”).
Rivian, LLC (“Rivian”) reserves the right to amend these Terms and terminate the Program at any time. Continued participation in the Program constitutes your acceptance of the amended Terms.
To earn a reward, you must (1) meet the program eligibility requirements (2) provide a qualifying referral that satisfies the eligibility criteria (“Eligible Referral”), and (3) comply with all other terms and conditions described in these Terms, including the Additional Terms. This Program is void where prohibited or restricted by law.
THE RIVIAN GENERAL TERMS INCLUDE TERMS FOR DISPUTE RESOLUTION, ARBITRATION, AND A WAIVER OF YOUR RIGHTS TO CLASS ACTIONS. THESE TERMS REQUIRE ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTION LAWSUITS.
1. Program Eligibility
This Program is open only to individuals who: (i) are legal residents of the United States (excluding those in Ohio and Virginia) (the “Eligible States”); (ii) have reached the age of majority in their state of residence; (iii) are physically residing in one of the Eligible States; and (iv) have been provided with Referral Code (as defined below) by Rivian. The Program is void where prohibited or restricted by law, including in Ohio and Virginia.
Rivian reserves the right to limit the number of rewards or terminate your participation if you fail to comply with these Terms or engage in actions that do not align with the underlying intent or purpose of the Program. This includes, but is not limited to, paid advertising, harassment of potential referral sources, using your Rivian vehicle for commercial purposes, unauthorized use of Rivian trademarks, or offering incentives for using a Referral Code.
Rivian reserves the right to modify, suspend or terminate the Program at any time without notice.
2. Participation
a. Eligibility
You can participate in the Program by using your unique code, available within your Rivian account (“Referral Code”) to share with potential new Rivian customers (“Referees”). A Referee must purchase or lease a new R1 vehicle through Rivian’s R1 Shop (the “Vehicle”) using your Referral Code. The Referee must also take delivery of the Vehicle and retain ownership beyond any applicable return period, if any. Rivian may limit the number of referrals per calendar year at its sole discretion.
You may use your Referral Code for your own vehicle purchases and receive both Referrer and Referee Rewards for such purchases.
b. Referral Code Restrictions
Referral Codes cannot be applied retroactively. Referrals for existing preorder and/or reservation holders who purchase vehicles using their current preorder and/or reservation are excluded from this Program.
c. Referrer Rewards
Subject to these Terms, the Referrer will be eligible to receive (i) six (6) months of charging with the Rivian Adventure Network and (ii) points toward purchases on our Gear Shop or a future vehicle purchase through our R1 Shop for each qualifying Referral (“Rewards”). The maximum lifetime charging benefit a Referrer can earn is capped at thirty-six (36) months. Rewards will be granted within two (2) weeks of the Referee’s vehicle delivery, and the grant date and the first name of the Referee will be reflected in the Referrer’s Rivian account. No cash equivalents or substitutions are allowed.
d. Referee Rewards
Subject to these Terms, the Referee who is the subject of an Eligible Referral and purchases a Vehicle through Rivian’s R1 Shop will be eligible to receive (i) six (6) months of charging with the Rivian Adventure Network after taking delivery of their Vehicle, and (ii) points toward purchases on our Gear Shop or a future vehicle purchase through our R1 Shop (“Referee Reward”). Referee Rewards are limited to one per Vehicle and are non-transferable. No cash equivalents or substitutions are allowed.
e. Reward Points
Points are granted as follows and expire two (2) years from the grant date:
Referrer: 750 points per qualifying Referral. Points are redeemable for an equivalent dollar credit towards purchases on our Gear Shop or a future vehicle purchase through our R1 Shop.
Referee: 750 points per Referee Reward. Points are redeemable for an equivalent dollar credit towards purchases on our Gear Shop or a future vehicle purchase through our R1 Shop.
Points cannot be used for vehicle deposits, custom vehicle configurations, reservations, or purchases outside of Rivian’s R1 Shop or Gear Shop. Additional exclusions and limitations may apply.
Rivian reserves the right to modify the number of points granted, any redemption benefits, and the expiration date of points at its sole discretion. Rivian may conduct an annual review of the rewards granted under the Program, during which Rivian may adjust available options or redemption requirements as needed.
f. Charging Rewards
Additional Fees: The charging reward applies only to the Rivian Adventure Network and excludes third-party charging networks (“Charging Reward”). You are responsible for any additional fees incurred during charging, including idle fees.
Validity: Charging Rewards are valid for six (6) months from the grant date. The maximum lifetime benefit for any Referrer is thirty-six (36) months of charging on the Rivian Adventure Network. When additional Charging Rewards are earned, the expiration date will extend by six months from the most recent grant date.
Ownership: Charging Rewards are tied to you as the vehicle owner. Upon selling or transferring your Vehicle, your Charging Reward will terminate. If you purchase another Rivian vehicle from Rivian and have a remaining Charging Reward balance, contact Rivian Support for assistance in transferring the remaining balance. Rivian reserves the right to limit the number of Charging Reward transfers. For owners of multiple vehicles, you may select which vehicle receives the Charging Reward within your Rivian account. Once selected, this cannot be changed.
g. Additional Rewards and Experiences.
Rivian may, from time-to-time at its sole discretion, offer additional rewards or experiences to Referrers who reach certain milestones.
Referrers who have made 25 qualifying Referrals may be eligible to attend a Rivian-hosted weekend experience within the United States. This experience includes domestic economy-class airfare, accommodations, and meals (three per day), all of which will be arranged through Rivian or its vendors (the “Rivian Experience”).
Eligibility is limited to the first one hundred (100) Referrers who have made 25 qualifying Referrals. The Rivian Experience is non-transferable and cannot be exchanged for cash or any alternatives.
Referrers will be notified of their eligibility and will be provided at least ninety (90) days’ notice for the proposed date and location of the Rivian Experience.
If a Referrer is unable to attend, the Rivian Experience will be forfeited and cannot be exchanged for cash or substituted for any other reward unless otherwise communicated in writing by Rivian.
Rivian is not responsible for any undelivered emails, messages or any other communications, including but not limited to those that are not received because of the Referrer’s privacy or spam filter settings that may divert any email, message or other related email to a spam or junk folder.
Rivian reserves the right to modify, substitute, or discontinue the Rivian Experience at any time and may replace it with a different reward or experience.
h. Rewards decisions. All reward decisions made by Rivian are final. Rivian reserves the right to determine the grant date, eligibility and qualification criteria of any Referral. For questions regarding the Program or a particular Reward, please contact Rivian via email at customerservice@rivian.com.
i. No employment or agency. This Program does not create an employment or agency relationship between Rivian with any Referrer. Referrers shall not represent themselves as acting on behalf of Rivian, nor are Referrers entitled to any compensation other than the Referral Rewards.
j. General. By participating in the Program, you agree to the following:
You agree not to engage in the use of paid advertising, harassment of potential referral sources, unauthorized use of Rivian trademarks, or conduct any bargaining with or for the rewards received in the Program, including offering incentives for using a Referral Code.
Rewards are strictly non-transferable and cannot be sold, exchanged, bartered, brokered, purchased, or otherwise assigned.
Rewards are not eligible to be combined with other discounts, packages or promotional offers from Rivian unless expressly authorized by Rivian.
Participants must conduct themselves ethically, ensuring that all rewards result from good faith recommendations and without any form of coercion or misrepresentation.
Rivian reserves the right to audit activities related to this Program to ensure compliance with these Terms.
Rivian may amend, suspend, or terminate the Program at any time without notice, which may affect the availability or value of previously accrued rewards.
Misuse of the Program or any fraudulent activity may result in the immediate suspension or termination of your participation in the Program and forfeiture of any accumulated rewards.
3. Taxes
Referrers are responsible for applicable federal, state, municipal and local taxes, fees and other government assessments that may arise from their participation in this Program. Federal and state withholding laws are subject to change without notice.
4. Program Changes
Rivian reserves the right to modify, suspend, or terminate the Program, the Terms and Additional Terms at any time. Changes are effective immediately upon posting. By accessing these Terms or otherwise participating in the Program, you are accepting and agreeing to be bound by the Terms as modified by Rivian from time-to-time. You are responsible for staying informed of any updates to the Program and/or the Terms and reviewing the Terms each time you use or access the Program. If you do not agree to be bound by the Terms and/or Program as modified, your only recourse is to cease/not initiate participation in the Program. Rivian may, but is not required to, notify you of any Program updates, modifications or changes and will not be liable for any failure to do so.
5. General
a. Rivian reserves the right in its sole discretion to disqualify any individual who: (i) tampers or attempts to tamper with the operation of the Program; (ii) violates the Terms; (iii) acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (iv) engages in actions or behaviors that Rivian deems inappropriate.
b. Rivian and any of its affiliates, parent, subsidiaries, contractors and all service agencies involved with the Program (collectively, “Program Entities”) are not responsible for any incorrect or inaccurate information, whether caused by website users, human error, tampering, hacking or by any of the equipment or programming associated with or utilized in the Program and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission (including availability or accessibility of the Internet), incompatibility, communications failure, modification, theft, loss or destruction of Referral Codes. Should any conflict or discrepancy arise in Program communications, announcements, advertising, or promotional materials relating to this Program, these Terms shall govern.
c. The Referral Reward is awarded “as is” without any express or implied warranty or guarantee from Rivian, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Only the Referral Reward as described herein is available to be awarded; in no event will the Program Entities be responsible for awarding more or different rewards than stated herein.
6. Privacy
Information submitted in connection with the Program will be treated in accordance with these Terms and the Rivian General Terms and Data Privacy Notice, which may be amended from time to time and located at https://rivian.com/legal/terms and https://rivian.com/legal/privacy, respectively.
7. Release
By participating, you agree to release and hold harmless Rivian, its respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents, and representatives of any of the above organizations from any injury, loss, or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of the Referral Reward or participation in the Program. You further acknowledge that you may be waiving rights with respect to claims that are at this time unknown or unsuspected, and, to the extent relevant to them, in accordance with such waiver, you acknowledge that you have read and understand, and hereby expressly waive, the benefits of Section 1542 of the Civil Code of California, and any similar law of any state or territory, which provides as follows: “a general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”
This Program is intended for viewing in the United States only and shall be construed and evaluated only according to United States law. Do not participate in this Program if you are not located in the Eligible States and, more specifically, if you do not comply with eligibility requirements in Section 1.
8. Force Majeure
Program Entities shall not be liable to you, or any other person or entity for failure to execute the Program, supply the Referral Reward (including Rivian Experiences) or any part thereof or the integrity and/or feasibility of the Program is severely undermined by reason of any act of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulation, order or request proves to be invalid), equipment failure, terrorist act, cyber-attack, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, epidemics, pandemics, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, cancellation or delay of any event, or any similar or dissimilar event beyond their reasonable control. In connection with the foregoing, Rivian shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Program without further obligation.
9. Severability
If any provision of these Terms is determined to be invalid or unenforceable, all remaining provisions will remain in full force and effect. Rivian’s failure to enforce any of its rights under these Terms does not constitute a waiver of such rights in any other instance.
