Rivian AI Use Terms

RIVIAN AI SERVICES GENERATE CONTENT AND RESPONSES USING MACHINE LEARNING MODELS. THESE OUTPUTS ARE AUTOMATED AND NOT SUBJECT TO HUMAN REVIEW. DUE TO THE NATURE OF AI TECHNOLOGY, OUTPUT MAY INCLUDE INACCURACIES, OUTDATED INFORMATION, OR BIASES. AI SERVICES ARE NOT AUTHORIZED TO BIND RIVIAN IN ANY WAY. ANY REPRESENTATIONS ABOUT PRODUCTS, FEATURES, CAPABlILITIES, OR PRICING PROVIDED BY THE AI SERVICES MAY NOT BE ACCURATE AND SHOULD NOT BE RELIED UPON AS DEFINITIVE OR OFFICIAL.
USERS SHOULD RELY ON OFFICIAL RIVIAN-PUBLISHED MATERIALS, INCLUDING OWNER GUIDES, WARRANTY GUIDES OR RIVIAN SUPPORT CENTER RESOURCES, FOR VERIFIED AND ACCURATE INFORMATION.
1. Applicability
These Rivian AI Terms (“Terms”) govern your access and use of products, services, features, enhancements, software, statistical learning algorithms, models, neural networks, databases, technologies, and/or developments that incorporate AI technology provided by Rivian (“AI Services” and each, an “AI Service”). By using the AI Services, you agree to these Terms, Rivian’s General Terms (“Rivian Terms”) and acknowledge Rivian’s Data Privacy Notice.
THE RIVIAN TERMS INCLUDE TERMS FOR DISPUTE RESOLUTION, ARBITRATION, AND A WAIVER OF YOUR RIGHTS TO CLASS ACTIONS. THESE TERMS REQUIRE ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTION LAWSUITS.
2. Age Requirement
AI Services are intended for individuals aged 18 or older, or the age of majority in your jurisdiction. By accessing or using the AI Services, you confirm that you meet this requirement.
3. Scope of AI Services
AI Services may be integrated into various Rivian platforms, products and services to enhance user experience. These include, but are not limited to:
Rivian Assistant: Facilitating service requests, appointment scheduling, and diagnostic insights via the Rivian mobile app.
4. Data Collection and Privacy
Rivian may collect logs, queries, and related data generated during your use of the AI Services to:
Enhance Functionality and Performance: To develop, enhance, and improve the accuracy, reliability, and responsiveness of the AI Services.
Monitor Compliance: To ensure adherence to Rivian’s terms, policies, and applicable laws, ensuring the AI Services are used appropriately.
Personalize User Experience: To deliver tailored and relevant responses or features based on your interactions.
The information you provide to Rivian will be used in accordance with Rivian’s Data Privacy Notice, which is incorporated herein by reference. Please read our Data Privacy Notice carefully to understand Rivian’s practices regarding your information and how it will be treated. 5. Nature of AI Services
AI Services utilize machine learning models to process user-provided input (“Input”) and generate audiovisual output (“Output”). These models are designed to operate independently of human intervention and provide real-time assistance.
6. Input and Output Responsibilities
Input
You are responsible for ensuring that your Input:
Complies with applicable laws, regulations, and third-party rights.
Does not contain sensitive personal data or confidential information.
Complies with Rivian’s User Content and Standards as outlined in Rivian’s General Terms. Prohibited content includes, but is not limited to, content that is libelous, obscene, defamatory, offensive, hateful, fraudulent, infringing, unlawful, or otherwise inappropriate.
Users may not direct the AI Services to generate any Output that violates intellectual property rights, contractual obligations, or other laws. By submitting Input, you confirm that you have obtained all rights and permissions necessary for such Input.
Rivian reserves the right to use de-identified or aggregated data derived from Inputs to develop, enhance and improve the functionality and performance of its AI Services. For clarity, this means any Input that Rivian uses will not be directly associated with or linked to you.
Output
AI Services generate responses or results based on Input. Output:
May contain inaccuracies, biases, or incomplete information.
May include identical or similar responses provided to other users.
Should be independently evaluated for accuracy and applicability.
Rivian makes no representations or warranties regarding the accuracy, reliability, completeness, or fitness of any purpose of the Output. All risks associated with the use of the Output remain solely with you. Rivian expressly disclaims all liability for any actions taken or decisions made in reliance on such Output, including but not limited to any legal, financial, or personal consequences. See Section 9 (Disclaimer of Warranties) and Section 10 (Limitation of Liability) below.
7. Ownership of Input and Output
Input
By providing Input, you grant Rivian a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, process, store, reproduce, modify, and adapt your Input to provide, train, develop, modify, adapt, improve, and enhance the AI Services. You acknowledge that Rivian owns and retains all rights, title, and interest in and to the AI Services, including the software, algorithms, models, and technologies used to process Input and generate Output.
By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) as part of the Input or otherwise to Rivian, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Rivian is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Rivian shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media now known or later developed and throughout the universe; (d) Rivian may have something similar to the Contributions already under consideration or in development; (e) your Contributions, including any intellectual property rights therein, automatically become the property of Rivian without any obligation of Rivian to you; and (f) Rivian is free to use any ideas, concepts, or techniques that you send Rivian for any purpose, including but not limited to, developing and marketing products that incorporate such ideas, concepts or techniques; and (g) you are not entitled to any compensation or reimbursement of any kind from Rivian under any circumstances.
Output
Rivian hereby grants you a non-exclusive, royalty-free license to reproduce, distribute, and use and display the Output specifically and solely as generated in response to your Input, where permitted by law. Due to the nature of AI, Rivian does not guarantee that Output will be unique and reserves the right to reuse or adapt similar Output generated for other users. Users acknowledge that Input and Output may be processed by third-party service providers as outlined in Section 11 (Third-Party Providers) below.
8. Fair Usage
Your use of AI Services is subject to fair usage limitations to ensure availability for all users. Prohibited activities include but are not limited to:
Excessive, abusive, or automated requests designed to overload the AI Services.
Using AI Services to generate spam, harmful or malicious content.
Exploiting AI Services for unauthorized commercial purposes.
Misusing AI Services in ways that violate Rivian’s General Terms.
Attempting to reverse engineer, reverse assemble or otherwise attempt to discover or derive the source code, algorithms, or underlying structure of any Rivian products.
Rivian reserves the right to suspend or terminate access to AI Services for misuse or violations.
9. Disclaimer of Warranties
EXCEPT TO THE EXTENT OTHERWISE PROVIDED HEREIN (SUCH AS LIMITED WARRANTIES) OR PROHIBITED BY LAW, ALL SERVICES DESCRIBED HEREIN ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND RIVIAN HEREBY EXPRESSLY DISCLAIMS ALL IMPLIED AND STATUTORY WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS. RIVIAN DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THEIR OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SERVICES WILL BE CORRECTED, AND ANY RISK ARISING OUT OF YOUR USE OF THE SERVICES REMAINS WITH YOU.
10. Limitation of Liability
No Consequential or Indirect Damages. EXCEPT AS OTHERWISE PROVIDED BY APPLICABLE LAW, IN NO EVENT SHALL RIVIAN OR ANY OF ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, LICENSORS AND PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH YOUR USE OF THE AI SERVICES, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE; (B) WHETHER OR NOT A PROPOSED DEFENDANT WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.
Maximum Liability. EXCEPT AS OTHERWISE PROVIDED BY APPLICABLE LAW, IN NO EVENT SHALL RIVIAN’S OR ANY OF ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, EMPLOYEES, LICENSORS AND PARTNERS AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE USE OF AI SERVICES, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE TOTAL OF THE AMOUNTS YOU PAID TO RIVIAN PURSUANT TO THESE TERMS.
This extends to your downloading, uploading or submission of any materials, data, text, images, video or audio from or to the AI Services, including but not limited to any issues caused by viruses, bugs, or any computer system, phone line, hardware, software or program malfunctions, or any other errors, failures or delays in computer transmissions or network connections. In the event of any problem with the AI Services, you agree that your sole remedy is to cease using the AI Services.
11. Third-Party Providers
AI Services may utilize technology or data models provided by third-party service providers, such as Azure OpenAI through Microsoft Corporation, to deliver certain features. Input you provide, including any personal data, may be shared with these providers and transferred to jurisdictions where data protection laws may differ. By using AI Services, you consent to such data sharing and are advised to avoid submitting sensitive or confidential information, as third-party providers may process or review Input data in accordance with their policies.
Rivian is not responsible for how third-party providers handle Input and disclaims liability for unauthorized use or breaches by these providers. By using the AI Services, you agree to comply with the terms and conditions of any third-party provider whose technology is integrated into the AI Services, including compliance with the terms outlined in the Microsoft Azure Product Terms.
12. Modification and Termination
Rivian may modify these terms and conditions at any time with or without notice to you and reserves the right to modify, suspend, or terminate the AI Services at any time without notice. Changes are effective immediately upon posting. Continued use of the AI Services constitutes acceptance of the updated terms.
