Civil Service of Process and Third-Party Data Requests
Where does Rivian accept service of legal documents?
U.S.A.
Rivian requires that all legal documents (including, for example, complaints, summonses, subpoenas, and garnishment orders) be served on our registered agent for service of process, CT Corp. Significant delays in response time may result if served by other means. The current contact information for the registered agent in each state is available online here.
Our registered agent will accept service only if the entity to whom the document is directed matches the name of the entity registered with the Secretary of State (e.g., “Rivian Automotive, Inc.” or “Rivian Automotive, LLC” or “Rivian, LLC”, etc.) and our agent is authorized to accept service on behalf of that entity. Our acceptance of legal process does not waive any legal objections we may have and may raise in response.
What legal process does Rivian require before producing data to private parties?
Rivian requires a valid subpoena issued in accordance with applicable law before processing a private request for information. Rivian requires all subpoenas to be served through Rivian’s registered agent for service of process, CT Corp. (See “Where does Rivian accept service of legal documents” above.) The current contact information for the registered agent in each state is available online here.
Our acceptance of legal process does not waive any legal objections we may have and may raise in response.
In what form does Rivian require subpoenas/data requests, and how are subpoenas/data requests processed?
Rivian will review each subpoena for facial and substantive validity and will reject those that are not facially or substantively valid. Among other things, subpoenas must be narrowly tailored and set a reasonable response deadline.
Rivian will reject overly broad, vague, or unduly burdensome subpoenas. Before making a request, please confirm the information sought is not publicly available.
If required by law to disclose data, Rivian will conduct a reasonable search and disclose/produce data responsive to the subpoena where applicable. Alternatively, Rivian may respond with objections that require curing and reissuing a defective subpoena. All valid subpoenas will be processed.
Please Note:
1) Rivian will not respond to emergency requests received from non-law enforcement officials. Non-law enforcement officials aware of an emergency should contact local law enforcement. For law enforcement requests, please see guidelines here.
2) Rivian provides a Certificate of Authenticity with its data productions which in most cases suffices to authenticate documents.
3) Rivian accepts service of subpoenas seeking witness testimony through its registered agent for service of process, CT Corp. (subject to the provisions listed above). Rivian may not be able to accommodate subpoenas for witness testimony served without a minimum of 21 days advance notice.
